...because whoever designed Denny Hamlin’s Hisense car he ran at Richmond a few weeks ago blatantly ripped off the Falken tire signature scallop design.

That’s kind of a grey area, as the logo itself is not ripping off Falken, in addition the colors are not the same, so the only thing that really could be infringing is the design of the scallops and the angle at which they sit on the car. And even with that, it may be a bit too vague to patent the shape ‘cause it’s not distinctive enough.

Meh, check out old hot rod and pro street magazines. This style is ollllllld and I doubt falken as any particular claim to it.

I think the point is you can’t trademark a paint scheme, it would he like chevy suing ford if ford for whatever reason started to use a hockey stick stripe along the side

It's almost blatant , but they could get away from only being inspired by. Btw falken makes a better tire than I ever thought after getting different rubber on my new car.
